The Supreme Court today (September 7) granted Guanwen Kuang, the chief executive of Vivo Mobile Communications, one month to approach the Chinese consulate and provide assurance that he will return to India to face prosecution after visiting his ailing father in China. Kuang, who faces prosecution under the Prevention of Money Laundering Act, approached the court after the Delhi High Court denied him permission to travel to Guangzhou, China, to visit his 82-year-old ailing father. Bench consisting of Justice Sanjay Kumar and Justice Sanjeev Sachdeva heard the case. Speaking in Kuang’s defense, the lawyer said he was just an employee. At first, Judge Kumar said that the trial was ready, but that guarantees were needed that he would return: “All we need is a guarantee that you will return and [face prosecution]…Why don’t you ask the consulate to support you and give guarantees, as they did in the other case? You are a Chinese citizen; tell them[your consulate] that your father is 82 years old and sick. Without a guarantee… Do you want to leave the country without any semblance of a guarantee?… You can [continue] video calls with your father.” He added: “We will postpone the matter, you take the consulate’s guarantee.“ Quan’s lawyer also said that he has already provided medical certificates from Chinese hospitals. He requested that the respondents could check the health of the applicant’s father, which would make the process a little easier. To this, Judge Kumar orally remarked: “Chinese hospitals are on par with Indian hospitals; we will give them this advantage. They are much more disciplined than we are about issuing certificates at the right price.” The Delhi High Court on July 9, 2026, refused permission, citing alleged proceeds of crime, his status as a Chinese national and the absence of an extradition treaty or mutual legal assistance treaty between India and China.
